Club Trade-In Terms and Conditions
These Terms and Conditions (the "Terms") govern your participation in TaylorMade adidas Golf Company's ("TaylorMade") Club Trade-In Program (the "Trade-In Program"). By clicking "Submit Order" and submitting your trade-in request, you agree to these Terms.
1. How to Trade-In Your Clubs
To participate in the Trade-In Program, while making a purchase of a new club(s) on www.taylormadegolf.com or www.adamsgolf.com, select the "Trade-In" option. Complete all requested information on the Trade-In Program form and submit the form. TaylorMade will provide you with an approximate value for your trade-in clubs. This value is an estimate only and is not binding on TaylorMade. The final valuation and credit will not be made until after your clubs are received and inspected by TaylorMade Pre-Owned . You must pay for your new clubs via credit card or gift card. Any credits will be issued in the form of your original payment method.
TaylorMade Pre-Owned will email you a pre-paid shipping label and a packing slip. You are responsible for packing and shipping your trade-in clubs using the shipping label and including the packing slip. TaylorMade will not reimburse you for any shipping charges; you must use the pre-paid label provided by TaylorMade Pre-Owned. You must ship your trade-in clubs to TaylorMade Pre-Owned within 30 days of your purchase or else the shipping label will expire and the trade-in will be void. TaylorMade is not responsible for any damage to your clubs incurred in transit or while evaluating the club(s).
Once your trade-in clubs are received, TaylorMade Pre-Owned will evaluate the clubs. We will provide you with the final valuation amount, usually within 10 business days of TaylorMade Pre-Owned's receipt of the trade-in clubs. If the valuation is the same as the initial estimate, TaylorMade will automatically issue a credit to you using the form of payment used to make your purchase. If your trade-in clubs are valued at less than the initial estimate when they are evaluated by TaylorMade, we will contact you directly. At your choice, you may proceed with the transaction accepting the credit for the lower amount or cancel the trade-in and/or your purchase.
TaylorMade may reject any trade-in for any reason in its sole discretion. Trade-ins may only be made when making a purchase of a new club(s) on www.taylormadegolf.com or www.adamsgolf.com. You may not trade in clubs worth more than the amount of your purchase. Only the clubs listed at taylormadegolf.com/tradein or www.adamsgolf.com/tradein may be traded in. TaylorMade reserves the right to add and remove clubs from the list of permitted clubs at any time and without notice. You may only send trade-ins from an address in the United States. The Trade-In Program is not offered outside of the United States. Clubs in the following condition may not be traded-in:
- Clubs that are dented, cracked, chipped, or that rattle.
- Metal woods with significant sky-marks on the crown.
- Clubs with cracked or bent shafts.
- Clubs with non-factory alterations.
- Wedges with excessive sole wear, groove wear, or dings.
- Iron sets that do not consist of 5-8 consecutive clubs or that do not have a pitching wedge or that do not match other clubs in the set.
- Counterfeit/knock-off clubs
Clubs that are included with your shipment that are in addition to, or different from, those clubs indicated on the Trade-In Program form will be valued at such club(s) applicable valuation amount and a credit will be issued to you, subject to these Terms.
If your trade-in clubs are valued at less than the initial estimate, at your choice, you may proceed with the transaction accepting the credit for the lower amount or cancel the trade-in and/or your purchase. If you decide to cancel the trade-in, you may choose to have your clubs returned to you at no additional cost or for TaylorMade to dispose of them. In the event your trade-in clubs are valued at less than the initial estimate, you may also choose to return your purchased clubs, even if they have been used. You may only return the clubs you purchased as part of the associated trade-in. You must make your elections within 7 days of the notification from TaylorMade. If you make no election within the time limit, TaylorMade will process your trade-in and issue a credit to you for the lower amount. Credit will be issued in the form of your original payment method. Except as otherwise provided in this Section, TaylorMade's Return Policy will apply to all purchases made as a part of the Trade-In Program.
Sales tax on your new club purchase will be calculated based on the retail price. Upon completion of a club trade-in, and if allowed by applicable law in your state, sales tax on your new club purchase will be recalculated based on the retail price less the final trade-in value determined by TaylorMade. In that event, you will receive a credit equal to any sales tax overpayment. Credit will be issued in the form of your original payment method. TaylorMade may modify the tax process described here, with or without notice, if it decides it is necessary to comply with applicable law.

UNLESS OTHERWISE SPECIFIED IN WRITING BY TAYLORMADE, THE TRADE-IN PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, TAYLORMADE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, AND NON-INFRINGEMENT OR FROM A COURSE OF DEALING OR USAGE OF TRADE.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree that any cause of action that may arise under these Terms will be brought in the appropriate court in San Diego County, California and you agree to submit to the personal and exclusive jurisdiction of the courts located in San Diego County. These Terms (including the additional terms incorporated by reference) are the only agreement between us concerning the Trade-In Program and supersede any other document, understanding or discussion. TaylorMade's failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. TaylorMade reserves the right to amend or cancel the Trade-In Program, including these Terms and the process by which clubs are traded-in, at any time, without notice, in its sole discretion. TaylorMade Pre-Owned is a third party that is in the business of, among other things, valuing, purchasing, and selling pre-owned golf clubs.
